SMC-R1 is an extra allowance for veterans at SMC-O or P level (maximum rate) who need regular aid and attendance. Regular aid includes help with bathing, dressing, feeding. 38 U.S.C. § 1114 and 38 CFR § 3.352 define the rules.
Must be at maximum rate (1114(o) or (p)) and require A&A. Regular A&A (non-professional help) suffices. TDIU counts as 100%. R1/R2 stop if hospitalized at VA expense.
VA Form 21-2680 (physician's A&A exam). Show need for daily assistance. Medical records of conditions causing that need.
